I heard maybe a handful of jokes mentioned at most. Mencia has hours of material. He stole all of it? I doubt it. Thats what this video makes it sound like. I dont follow either of these guys very much but considering the video was made by joe rogan i think its a little biased.

It doesn't matter how much of it is stolen, but the fact that any of it is stolen is one of several things: Definitely plagiarism, probably copyright infringement, and maybe trademark infringement (depending on the joke). Even if it's only one joke.

From reading more about it it would seem he has stolen a lot. Regardless of amount stolen it's the fact he's stolen ANYTHING that matters... being a comedian is hard, writing the material is hard. If you see the same comedian a lot you'll hear their same bits a lot because they use jokes as much as they can before they wear out...

Amazing how Mencia managed to steal material yet was never actually funny with it.

He got away with it because few people have such a deep appreciation for comedy that they have any of hundreds to thousands of jokes on demand to compare to the content of other jokes. People might experience a general sense of boredom with his material for the familiarity of the ideas, but because he rewords the ideas (if he is stealing), people couldn't easily place the joke. It's taken actual comics - people who have studied comedy and do it for a living - to call Carlos on stealing. That's why he can get away with it.

Everyone's talking about jokes as though the ideas contained in them should be copyrighted. If that were legally possible, why haven't all current bitches-&-hoes rap stars been tried? It's not like that in literature, either. The surface syntax and grammar containing the ideas has to match up for it to be plagiarism.
Carlos rewrites jokes, maybe. We don't even know that. The mexican-fence joke is pretty obvious - anyone could come up with it. Even if he is stealing jokes, he rewords it, and last I checked you can't plagarize ideas. I don't see legal action against Mencia, but I do see him losing respect. If this really does spread around, especially to the general public, he's pretty fucked, even if not legally apprehended. I can't be angry at him. More like sad for him. Sad little joke-stealing man, if that he is...
